What is Retail Fraud?

Several elements must be proven beyond a shadow of a doubt for you to be prosecuted with the charge of retail fraud. These include:

  • The prosecutor must prove the defendant intended to steal the property.
  • They must prove the collective value of the property in question.
  • The prosecutor must show that the defendant moved the property.
  • They must prove that the defendant took control of the property a store offered for sale.

The charge of first-degree retail fraud includes any property that is valued at over $1000 and will be considered a felony.  Second-degree charges occur when the property is valued between $200-1000.  This is considered a misdemeanor and can carry a jail time sentence for up to one year.  However, a first degree can mean prison time.  To a lesser degree, third-degree is punishable for 93 days in jail and is for things that are less than $200 in value.

If you have prior theft convictions, this could change.  The lesser degrees can move up the scale to include prison time for your multiple offenses.
